The Federal Motor Carrier Safety Administration (FMCSA) did not meet Friday’s court settlement deadline to issue its final Hours-of-Service (HOS) regulations.
The agency said it continues to “work toward publication” of the final HOS rules, but did not give a date as to when this might happen.
FMCSA said the plaintiffs in the HOS lawsuit, which include the Teamsters union and the advocacy organization Public Citizen, agreed to extend the deadline.
In its new Hours-of-Service (HOS) Proposed Rulemaking published on December 29, 2010, FMCSA said it was leaning toward cutting driving hours back to 10 from 11.
The agency also said it would modify the HOS regulations’ 34-hour reset provision by requiring that it include two rest periods of at least six hours and mandating that they fall between midnight and 6 a.m.
