OSHA: Truck driver fired by company for voicing concerns over vehicle safety

OSHA determined that Meridale, N.Y.-based Brindi Trailer Sales and Service, Inc. violated the anti-discrimination provisions of the Surface Transportation Assistance Act by dismissing an employee for reporting truck safety concerns.

The Occupational Safety and Health Administration (OSHA) determined that Meridale, N.Y.-based Brindi Trailer Sales and Service, Inc. violated the anti-discrimination provisions of the Surface Transportation Assistance Act by dismissing an employee for reporting truck safety concerns.
According to OSHA, the driver informed the company about a number of safety issues, including ineffective brakes, steering problems, non-functioning turn signals, leaks and a cracked windshield. OSHA says Brindi Trailer Sales and Service failed to fix the problems, and the driver eventually contacted the Pennsylvania Department of Transportation.
OSHA has ordered the company to pay the driver $32,642 in lost wages, $10,000 in punitive damages and more than $3,000 in attorney’s fees.
